The Tulalip Tribes Board of Directors is committed to providing a safe and healthy environment for Tribal Members, community residents and visitors to the Reservation. Exclusions are recognized as an inherent right of Federally Recognized Indian Tribes’ tribal sovereignty. The Tulalip Tribes uses this inherent power to exclude individuals from the Reservation as a necessary means to protect the political integrity, economic security, and/or the health or welfare of the Tribes.
Upon request by the Tulalip Tribes Board of Directors, the Office of Reservation Attorney files a petition in the Tulalip Tribal Court for an order excluding a person from restricted land or any portion thereof, unless a lawful resident of such property. The person being excluded is afforded due process in the Tulalip Tribal Court and has an opportunity to respond to the petition for exclusion. Once an order has been issued by the Tulalip Tribal Court imposing the exclusion, the Tulalip Tribes shall create an exclusion registry that is made publicly available.
Exclusion Deferral Program: this is option afforded to Tulalip Tribal Members, parents or children of Tulalip Tribal Members, or legal spouses of a Tulalip Tribal Member. If an excluded person has not been excluded for a crime that would otherwise deemed them ineligible, this person may apply to the Tribal Court for a deferral of exclusion. The Tulalip Tribal Court has exclusion deferral program paperwork available upon request.
